Terms and conditions of our photo booth hire

*Please take note of the below Terms and Conditions which apply from the moment a booking is confirmed. Without agreeing to the below Ts & Cs a booking cannot be confirmed

1. Provisions of Services

1.1 -  The Service Provider shall provide photo booth hire services to the client in accordance with the terms of this agreement.

1.2 - The service provider shall provide the services with reasonable skill and care, commensurate with prevailing standards and best practice in the industry in the United Kingdom.

1.3 - The service provider shall act in accordance with all reasonable instructions given by the client and co-operate with the client with respect to the provision of the services.

2. Equipment

2.1 - The client is liable to pay in full or for any damage; repair or loss of any equipment provided by The Pixipod during their booking, caused by the client or their guests and compensate for any loss of work.

3. Fees and Payments

3.1 - The service provider shall invoice the client for the fees once booking in confirmed.

3.2 - All deposits paid by the client are non-refundable and non-transferable.

3.3 - The client shall pay a 50% deposit of the total invoice to the service provider, should the confirmed event date be more than 4 weeks away. The remaining 50% shall be paid 2 weeks before the confirmed event date.

3.4 - The client shall pay the full invoice to the service provider should the confirmed event date be less than 4 weeks away.

3.5 - All payments are required to be made within 14 days of receipt of the relevant invoice.

3.6 - All payments shall be made in GBP in cleared funds to the bank account stipulated in the invoice.

3.7 - If settling the invoice balance via credit card, the client shall pay the website fee.

4. Pixipod Images

4.1 - All images taken by a  Pixipod photo booth during an event are property of the service provider.

4.2 - The client agrees that images taken throughout the duration of the booking may be uploaded to social media and the service provider’s website for marketing and promotional purposes unless agreed otherwise.

4.3 - The client agrees to inform the service provider in writing (or via the design questionnaire) should they wish their images not to be used.

4.4 - Where print out options are selected the client agrees to print all images throughout the duration of the booking and inform the service provider at the start of the booking should they wish the service provider to keep a copy aside for the client and the designated person to hand these to.

5. Cancellations

5.1 - The client agrees that all cancellations must be confirmed in writing via email, only then will they become effective.

      5.1.1 - Cancellations between 12-6 months prior to the booking date will be liable to pay 50% of the agreed booking total.

      5.1.2 - Cancellations between 6-3 months prior to the booking date will be liable to pay 75% of the agreed booking total.

      5.1.3 - Cancellations between 3 months prior to the booking date will be liable to pay 100% of the agreed booking total.

5.2 - In the event the booking is cancelled due to the changes in the rules, regulations or otherwise set by the UK Government regarding COVID-19 or any other pandemic, the booking (and any amounts paid in respect of the same) shall be fully transferable to another date elected by the client, subject to availability, without additional cost.

5.3 - Change of confirmed venue originally elected by the client could be liable for a s surplus charge depending on location (if the new venue is within congestion charge zone or outside usual operating areas within inner London.

5.4 - The service provider cannot be held responsible for circumstances that may prevent the, from attending a booking which may include but are not limited to: illness, severe weather conditions, national lockdowns, traffic delays, vehicle breakdown, sudden malfunction or breakdown of equipment as these are unavoidable and out of our control. However, we will make every effort to rectify the situation and attend your booking and, should this not be feasible and result in non-attendance, you will be refunded the total agreed booking fee.

6. Laws and Jurisdiction

6.1 - This agreement (including any non-contractual matters and obligations arising therefrom or associated therewith) shall be governed by, and construed in accordance with, the laws of England and Wales.

6.2 - Any dispute, controversy, proceedings or claim between the parties relating to this agreement (including any non-contractual matters and obligations arising therefrom or associated therewith) shall fall within the jurisdiction of the courts of England and Wales.
